Consumer Health Data Privacy Notice
A separate notice for health-adjacent and sexual-health-related information where applicable.
01Scope
This Notice supplements the Privacy Policy and applies where information SideOf handles is treated as consumer health data under applicable U.S. state law, including Washington's My Health My Data Act and similar laws. It is separate from the general Privacy Policy.
02Categories collected
Depending on what a member chooses to provide, categories may include sexual orientation, gender identity, relationship and intimacy preferences, safer-sex conversation preferences, consent and comfort preferences, and inferences strictly necessary to provide selected compatibility or safety functions. SideOf does not request medical records, diagnoses, prescriptions, biometric health measurements, or health-care treatment history for ordinary use.
SideOf does not collect, capture, store, use, or disclose a biometric identifier or biometric information, and it does not run face recognition, face matching, face geometry, voiceprint, fingerprint, iris or retina scanning, or any comparable measurement of your body. Photo approval, selfie verification, and the ID check for posting explicit photos are done by a person looking at the images. The age check for viewing explicit photos reads the barcode on your ID automatically; no person looks at it, and nothing about your face is measured. Where a check asks whether a face matches a selfie, that is a trained reviewer's own judgment recorded as a yes or no; SideOf does not generate, derive, store, sell, lease, trade, or otherwise profit from a template, faceprint, or other representation of a face used to identify or compare people, and it does not ask any provider to. The automated photo check described in the Privacy Policy looks for prohibited content; it does not identify anyone, compare faces, or return anything about a face. Images submitted for an identity or age check are deleted once the check is decided. They are kept longer only while a legal hold described in Privacy Policy Section 12 covers the account or the image is part of an intimate-image removal case, and a selfie you also use as a photo stays while it is on your profile or in a message. SideOf does not ask you to consent to biometric processing because it does not do any.
03Sources
Consumer health data comes directly from the member, from the member's interaction with the selected profile or compatibility controls, and from a person who submits a safety or rights request about their own information. SideOf does not buy consumer health data from data brokers.
04Purposes
SideOf collects and uses these choices to create the member-selected profile, apply compatibility filters, honor visibility and consent settings, prevent cross-Side disclosure, provide safety controls, investigate abuse, fulfill rights requests, secure the service, and comply with law. SideOf does not use consumer health data for advertising or to infer eligibility for employment, housing, credit, insurance, or health care.
05Sharing
SideOf currently shares consumer health data with no category of third party and no specific affiliate, as those terms are defined by the Washington My Health My Data Act. At a member's direction, selected fields may appear to other members. A member who is active on the Private Side and matched on Social or Dating with another member who is also active on the Private Side can see that the other is on Private, as the Privacy Policy explains. Contracted processors may handle only the minimum data needed for encrypted storage, hosting, security, moderation, or support; they are not statutory third parties. SideOf does not sell consumer health data. Before any new sharing category begins, SideOf will update this Notice and obtain any required consent.
06Consent and withdrawal
SideOf asks for your express consent before you join the Private Side and again before your Private answers are used for matching, and it records when you give or withdraw that consent. "Private answers" means your Private Compatibility answers (your role and position, expression, interests and dynamics, relationship structure, pace, consent and communication preferences, how you like to talk about safer sex, and what you're open to in others) and the roles, expressions, and interests you chose to filter Private by. You can withdraw consent at any time. Turning off Private Compatibility withdraws your consent to matching and deletes your Private answers at once. Stepping away from the Private Side withdraws both consents and deletes your Private answers at once. You can also clear any single answer, or delete all your Private answers, in Edit profile, or write to support@sideof.app with 'Consumer Health Data Request'. Withdrawing consent does not affect processing that was lawful before you withdrew it.
07Rights and requests
Where applicable, a consumer may confirm whether SideOf collects, shares, or sells consumer health data; access it; withdraw consent; and request deletion, including deletion from processors as required. To get a copy of the consumer health data SideOf holds about you, use Download my data in the app, in Settings, then Account. The file includes your profile, your Sides and their settings, your compatibility and Private answers, and when you gave or withdrew consent for Private, and Privacy Policy Section 15 explains what else it includes and what it leaves out. SideOf shares consumer health data with no third party or affiliate, as Section 5 explains, so there is no list of recipients to give. To delete, use Delete account or the Private controls described in Section 9. You can also make any request by emailing support@sideof.app with 'Consumer Health Data Request' in the subject line, including if you cannot sign in or your account is suspended; SideOf responds within 45 days, and may take up to 45 more days where the law allows if it tells you why within the first 45. SideOf authenticates requests using commercially reasonable methods and does not require creation of a new account.
08Appeals
If SideOf refuses a request, the response will explain the reason and how to appeal where required. Send an appeal to support@sideof.app with 'Consumer Health Data Appeal.' If an appeal is denied, the response will identify an appropriate regulator or complaint route when law requires.
09Security, retention, and changes
SideOf limits access, encrypts sensitive fields where designed, separates Side visibility, and keeps data only while needed for the selected feature or a permitted safety, security, legal, or dispute purpose. Your Private answers are deleted from SideOf's live systems at once when you delete them, turn off Private Compatibility, step away from the Private Side, or ask to delete your account (unless a legal hold applies to the account), and from encrypted backups on the schedule in the Privacy Policy. A deletion request sent to support is completed within the period the applicable state law allows. Stepping away hides your Private profile. Your Private bio, prompts, the interests shown on your profile, your photos, and your other discovery settings stay so that you can come back; they are deleted when you delete them or your account. Private messages follow the chat-history and ended-connection rules in the Privacy Policy. The only copies that outlive that are the ones on the closed retention list in the Privacy Policy, which exist because the law requires them, or to respond to reported harassment or illegal activity, for the limited periods stated there. SideOf will not add a category or materially different purpose inconsistent with this Notice without the disclosure and consent required by law. The current effective date appears on this Notice.
